On October 12, 2011, the judge in the Upper Deck v. Frontline Collectibles/Blowout Cards action (the case over Upper Deck's new distribution policy that I previously wrote about here and here) held an Early Neutral Evaluation Conference.
Legal translation: The judge thought this action might be an easy one to resolve quickly, so he had everybody come in, metaphorically hold hands and sing “Kumbaya" to see if maybe they could settle.
Later that same afternoon, the court issued an order. The most relevant phrase from the order, “The case did not settle."
Legal translation – The rendition of “Kumbaya" was not rousing, the parties are not getting along…so, they're just going to have to fight it out.
The next date of interest in this action is December 5 where the parties will be back in the courtroom to firm up a schedule for the case.
